Womack introduces legislation to modernize the Flag Code

WASHINGTON, DC —Congressman Steve Womack (AR-3) today introduced the Flag Code Modernization Act of 2021. The bipartisan legislation modernizes the U.S. Flag Code to codify several longstanding traditions and practices related to the display and use of our national emblem. While many of these customs are already commonplace, they are technically illegal, and the existing statute could prevent law-abiding Americans from expressing their patriotism.
Congressman Womack said, “The American flag is one of the greatest symbols of our nation. The red, white, and blue shines as an enduring beacon of hope, and patriotic citizens are proud to display it. This legislation simply modernizes the U.S. Flag Code to reflect the special traditions and practices that have become commonplace. At a time when we are seeing increased disrespect for Old Glory, I am proud to ensure Americans have every opportunity to celebrate and show reverence for our flag.”
The American Legion said, “The American Legion believes the U.S. flag, which predates the U.S. Constitution, says “America” more than any other symbol. The flag represents the values, traditions and aspirations that bind Americans together as a nation. It stands above the fray of day-to-day politics and unites the nation in times of crisis. Therefore, The American Legion urges Congress to approve changes to the U.S. Flag Code to codify multiple accepted patriotic customs and practices pertaining to the display and use of it. The American Legion thanks Representative Womack for championing the Flag Code Modernization Act of 2021.”

The Flag Code Modernization Act of 2021 amends the U.S. Flag Code to ensure certain customs involving the American Flag do not violate federal law. Some of the illegal customs included for modernization are displaying the American flag horizontally at sporting events or other civic gatherings, allowing temporary items (cushions, napkins, boxes, etc.) to bear the image of the American flag, and providing non-profit organizations and businesses the authority to display the flag. The bill also expands the list of approved days for the flag to be displayed, allows for U.S. postal workers to wear the American flag on their uniforms, and provides for the location of other nations’ flags.
The lead Democrat sponsor of the bill is Congressman Jared Golden (ME-2), and other original cosponsors include Representatives Jim Baird (IN-4), Tom Cole (OK-4), Rick Crawford (AR-1), Scott DesJarlais (TN-4), Louie Gohmert (TX-1), Jenniffer Gonzalez-Colon (PR-At-Large), and Bruce Westerman (AR-4).
